For the purposes of this Privacy Policy, unless otherwise noted, all references to EMKAY, Inc. include its website, mobile applications, and related services.
EMKAY, Inc. may collect personally identifiable information, such as your name as it relates to services and interactions you have with EMKAY, Inc. We may gather additional personal or non-personal information in the future.
Information about your computer hardware and software may be automatically collected by EMKAY, Inc. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the EMKAY, Inc. website or mobile app.
If your company has enabled the automatic mileage tracking feature, and you opt in as a driver, the Driver 360 mobile app collects device location data, including precise location, approximate location, and location collected in the background while the app is closed or not in active use. This location data is collected together with trip start and end times, distance, duration, route information, motion and activity data, and any trip classifications or notes you assign. This information is used solely to automatically detect, record, and report your driving trips for business mileage tracking, reporting, and analytics purposes. Location data is collected automatically using technology provided by a third-party mileage tracking provider, and is transmitted to and stored on that provider’s infrastructure as described in the “Data Sharing with Third- Party Technology Provider” section below. Collection requires certain device permissions, including background location access and activity recognition, to function correctly. Location data is not used for advertising purposes. You can disable automatic tracking at any time within the app, after which the app stops collecting location and motion data for trip purposes.
EMKAY, Inc. encourages you to review the privacy statements of websites you choose to link to from EMKAY, Inc. so that you can understand how those websites collect, use and share your information. EMKAY, Inc. is not responsible for the privacy statements or other content on websites outside of the EMKAY, Inc. website or mobile app.
Automatic mileage tracking is an opt-in feature. Drivers can enable or disable automatic tracking at any time within the app. When automatic tracking is disabled, the app does not collect background location data, does not detect trips, and does not use motion sensors for trip-related purposes. Previously recorded trips remain accessible within the app in accordance with the data retention and deletion practices described below.
Trip data collected through the automatic mileage tracking feature is processed using a third-party software development kit (SDK) integrated into the Driver 360 app. Trip data is transmitted to and stored on the provider's infrastructure. EMKAY accesses this data through the provider's secure APIs to deliver mileage tracking, reporting, and analytics within the app. The provider is bound by the same restrictions as other third-party service providers described in this policy.
EMKAY, Inc. collects and uses your personal information to operate its website(s) or mobile apps to deliver the services you or your company has requested.
EMKAY, Inc. may also use your personally identifiable information to inform you of other products or services available from EMKAY, Inc. and its affiliates. EMKAY, Inc. may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.
EMKAY, Inc. does not sell, rent or lease its customer lists to third parties.
EMKAY, Inc. may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to EMKAY, Inc., and they are required to maintain the confidentiality of your information.
EMKAY, Inc. will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on EMKAY, Inc. or the site; (b) protect and defend the rights or property of EMKAY, Inc.; and, (c) act under exigent circumstances to protect the personal safety of users of EMKAY, Inc., or the public.
EMKAY, Inc. will retain data collected for the use of the services requested by your organization for as long as there is an agreement in place between EMKAY, Inc. and your organization plus a period of 7 years. After that time any data will be purged using a current acceptable standard method of purging data.
Because Driver 360 is provided to drivers through their employer or fleet organization, requests to access or delete personal data are administered through that organization. Drivers who wish to have their data deleted should contact their fleet administrator or organization, who can coordinate the request with EMKAY. EMKAY can also be contacted directly using the contact information at the end of this policy to facilitate data deletion requests, subject to any legal or contractual retention obligations described in the Data Retention section above. Certain data may be retained as described in the Data Retention section above where required for legitimate business purposes, including security, fraud prevention, regulatory compliance, or to fulfill contractual obligations with your organization.
EMKAY, Inc. will notify the affected parties via email within 48 hours upon an independently verified data breach.
The EMKAY, Inc. website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

Trip and location data collected by the Driver 360 app is transmitted to EMKAY and its technology provider's servers using encrypted connections. Data is stored in secured environments with access controls to protect against unauthorized access.
