Alberta’s New Impaired Driving Laws

On December 1, 2020 the Provincial Administrative Act was enacted. The Act introduces immediate and escalating consequences for impaired drivers including fines up to $2,000, increased length of vehicle seizures, and increased driver’s license suspensions. A new administrative penalty for commercial drivers has also been introduced. This policy imposes zero tolerance for drugs and alcohol for commercial drivers operating commercial vehicles, registered vehicles greater than 11,794 kilograms, or commercial vehicles with manufacturer seating for 11+ passengers (including the driver). The Government of Alberta has stated that commercial drivers operating commercial capacity are to be held to a higher standard due to the complexity and size of commercial vehicles.
